Autism/PDD in the Classroom. Get a lawyer or move closer to an Autism School?

We are faced with a dilemma in our family. We can leave our PDD diagnosed daughter in the public school system that is somewhat clueless, it seems, when it comes to Autism. Right now, we have been rejected on our wish to have a full time aide to a) keep her on task (primary function) and b) reduce flight risk. The aide who was pretty much a full time aide for us last year, was moved to another class and subsequently resigned her position (lots of political school drama involved). We tried to hire HER and pay for it out of our own pockets. Rejected. She was qualified enough last week, but not this week if WE pay her.
